Where a settlement by consent is not achievable, whatever the nature of the dispute the courts’ rules generally require the parties and their legal advisors at an early stage to attend relatively informal meetings in the presence of a judge to define the issues and attempt a settlement through negotiation. If that fails the court will give directions for the filing of formal evidence and set a date for a final hearing. A contested financial application will generally take 9 months from commencement to a hearing at which a solution is imposed on the parties.

For those living abroad we will need to consider how quickly proceedings should start and whether England is the best country for the divorce to take place.
